Recent Case: Obtained TN Visa for Canadian IT Professional

In one of our immigration case victories at Fayad Law, P.C., we recently helped a Canadian IT professional obtain a TN visa so that he could work in the United States—despite fact that he was facing certain challenges. According to the U.S. Department of State’s Bureau of Consular Affairs, the TN visa is a nonimmigrant visa that was created under the North American Free Trade Agreement (NAFTA), which established certain trade and economic relationships between Canada, Mexico and the U.S. Another name for the TN visa is the NAFTA Professional visa.

With a TN visa, a Canadian or Mexican citizen is considered a NAFTA professional and is given clearance to work in the U.S. in pre-determined business activities. This employment can be for a U.S. employer or a foreign employer. In order to successfully obtain this visa, the Canadian or Mexican national must work in a profession that is on the NAFTA list, and he or she must also meet other requirements. Most of the professions on the NAFTA list require a bachelor’s degree or a higher degree.

In this particular case, our client did not have the bachelor’s degree that was required for his NAFTA profession. Instead of letting this barrier stop the Canadian national, we helped him find an alternate solution—we helped him qualify for another position that did not require a bachelor’s degree. Within less than a month, he was able to get a TN visa for the position of a Management Consultant, for which no bachelor’s degree was required.
