¿Cuál es la diferencia entre una visa de inmigrante y no inmigrante?

Hay docenas de diferentes tipos de visas disponibles bajo las disposiciones de la Ley de Inmigración y Nacionalidad (INA), pero todas pueden clasificarse en dos categorías: visas de inmigrante y no inmigrante. La primera es destinada para aquellos que desean establecerse como residentes permanentes y, posiblemente, obtener la naturalización o la ciudadanía. La segunda es para aquellos que planean únicamente visitar los Estados Unidos, por ejemplo, por motivo de negocios o de estudios.

¿Cuántos inmigrantes se admiten cada año en los Estados Unidos?

La INA establece los límites de personas que podrán emigrar cada año a los Estados Unidos utilizando ciertos tipos de visas, mientras que otras son ilimitadas. Las visas de inmigración familiar para familiares directos de ciudadanos estadounidenses están disponibles de forma ilimitada, mientras que hay cuotas anuales establecidas para los familiares de residentes permanentes legales y la familia de los ciudadanos, con una cuota máxima de 480,000. ¿Qué es la acción diferida?

En junio de 2012, la administración de Obama ordenó al Departamento de Seguridad Nacional (DHS) que comenzará a aplicar una política que se conoce como Acción diferida para los llegados en la infancia (DACA). Bajo dicha acción, el DHS está ejerciendo su discreción en la ejecución de las leyes sobre la deportación y expulsión de inmigrantes que se encuentran ilegalmente en los Estados Unidos. La acción diferida no representa un cambio en la ley actual, sino que es un cambio en la forma en la que se aplica la ley. Usted puede calificar bajo la DACA si tenía menos de 31 años el 15 de Junio del 2012 cuando vino por primera vez a EE.UU. y antes de cumplir 16 años, también si ha residido continuamente en este país desde el 15 de Junio del 2007 y está estudiando actualmente o si ya se ha graduado del bachillerato o ha obtenido su certificado de desarrollo educativo general (GED), entre otros criterios. Con la acción diferida puede evitar ser deportado, aunque no le otorga ningún cambio en su estatus migratorio.

¿Cuáles son los factores que el USCIS considera al revisar una solicitud de inmigración?

En la revisión de solicitudes de visa de inmigración, el Servicio de Inmigración y Ciudadanía de EE.UU. (USCIS) considera los factores relacionados con los vínculos que el inmigrante tiene con los Estado Unidos y las razones por las cuales el solicitante desea o necesita vivir en este país. Por ejemplo, una solicitud de inmigración familiar no puede ser aprobada a menos que el extranjero en cuestión tenga familiares directos, tales como: cónyuge, madre o padre, hijos o hermanos viviendo actualmente en el país como ciudadanos o residentes permanentes. Es más probable que se apruebe una solicitud de inmigración basada en empleo si el solicitante tiene una oferta de trabajo en este país y viene a cubrir un puesto que no puede ser ocupado por alguien del mercado laboral local. A un extranjero que está huyendo de una persecución en su país se le puede otorgar una visa como refugiado o de asilo político.

¿Cómo es posible evitar una deportación?

Existen muchas estrategias para enfrentar una acción de deportación. Si la deportación propuesta está basada en una condena criminal, es posible apelar dicha condena para anularla. Otra opción es solicitar una cancelación de expulsión, lo que es un tipo de dispensa de inmigración, y la cual está disponible para personas de buen carácter moral y cuya deportación sometería a un familiar ciudadano o residente permanente a dificultades extremas.
