A Case of Mistaken Identity Leads to Removal Proceedings

Our firm recently helped a client clear his name and reopen his immigration case so that he could be given another opportunity to seek relief in the immigration court. The man had originally come to the United States on a B-2 visa back in the 1990s. Years later he married a U.S. citizen and was able to obtain legal permanent residence in 2009 based on that marriage.

As a result of a mistaken identity, United States Citizenship and Immigration Services (USCIS) believed the man had willfully misrepresented himself for the purpose of illegally obtaining permanent residency in the United States, so they charged him with fraud and placed him in removal proceedings. Due to exceptional circumstances the man never received any notification to appear before the court and ended up missing his 2010 hearing. He was then ordered by the court to be removed in absentia. In 2013, our client was approached by Immigration and Customs Enforcement (ICE) and informed that he had an existing order of removal.

He contacted us and we immediately filed a motion to reopen on his behalf. The motion to reopen was granted based on asylum and changed country conditions as our client had converted from Islam to Christianity and feared he would be tortured and his life put at risk if he were to return to his home country of Yemen. We were also able to address the false charges levied against our client and we look forward to assisting him further in his pursuit of relief through the immigration court.
